Payment Processing Overview

Hopemeter processes all transactions through Payment processors, a certified PCI Level 1 payment service provider. We do not store, transmit, or have access to your complete payment card information. All payment data is encrypted end-to-end and handled exclusively by Stripe's secure infrastructure.

Pricing Structure

Signal costs are determined by Hopemeter and may vary based on topic, timing, and platform-wide settings. Current pricing is displayed before each transaction. All prices are final and inclusive of applicable taxes.

No Refunds Policy

All signal payments are final and non-refundable once processed. Signals, once submitted and recorded, cannot be deleted or reversed. This applies regardless of market conditions, sentiment shifts, or personal change of mind.

Fraud Prevention & Disputed Transactions

• Chargeback Claims: Fraudulent chargebacks may result in permanent account suspension and legal action.
• Suspicious Activity: Accounts exhibiting suspicious payment patterns may be frozen pending verification.
• Verification: We may require identity verification or additional documentation for high-value transactions.
• Failed Payments: Multiple failed payment attempts may trigger account restrictions.

Signals Are Opinion Expressions, Not Financial Products

Signals on Hopemeter represent your expression of sentiment on a topic. They are not:

• Financial Instruments: Signals have no monetary value, cannot be traded, and do not constitute ownership.
• Investments or Securities: Signals are not shares, bonds, derivatives, or any regulated investment product.
• Gambling or Wagering: Signals do not involve betting, prediction markets, or expectation of financial returns.
• Contracts: Expressing a signal does not create a binding legal contract.
• Advice: Signals are personal opinions, not professional advice of any kind.

No Regulatory Status as Securities or Derivatives

Hopemeter is explicitly structured to avoid regulation as a gambling platform, securities exchange, derivatives marketplace, or financial services provider. The platform does not fall under SEC, FINRA, CFTC, or state gaming board jurisdiction.

Eligibility Requirements

• Age: You must be at least 18 years old (or the age of majority in your jurisdiction).
• Legal Capacity: You must have the legal capacity to enter into this agreement.
• Jurisdiction: You must be in a jurisdiction where Hopemeter's service is lawfully available.
• Sanctions: You must not be subject to any sanctions lists or trade restrictions.
• Account Verification: You may be required to verify your identity through payment processing.

User Responsibilities

• Accurate Information: Provide truthful, complete, and current information.
• Account Security: Maintain the confidentiality of your account credentials.
• Legal Compliance: Use Hopemeter only for lawful purposes.
• Authentic Expression: Submit signals that genuinely reflect your actual sentiment.
• Payment Responsibility: You are responsible for all charges incurred through your account.

Prohibited Activities

• Using automated bots or scripts to submit signals
• Submitting signals through fraudulent or stolen payment methods
• Coordinating with others to manipulate sentiment measurements
• Using multiple accounts to artificially inflate signal counts
• Submitting false, defamatory, or illegal content
• Attempting unauthorized access to platform systems
• Harassing or threatening other users
• Circumventing geographic restrictions or sanctions limitations

Hopemeter's Authority

Hopemeter LLC retains absolute authority over platform operations, including the right to:

• Modify, remove, or quarantine signals that violate terms
• Temporarily or permanently restrict user access
• Discontinue platform operation or user participation
• Change signal costs, pricing structure, or payment terms
• Add, remove, or modify platform features
• Monitor and analyze platform activity for fraud detection

Content Moderation & Removal Rights

Hopemeter reserves the right to remove, edit, or quarantine any signal that violates applicable law, contains malicious code, appears to be part of coordinated manipulation, or violates intellectual property rights. Removal does not constitute refund of associated payments.

Intellectual Property Rights

Hopemeter retains all rights to the platform, its code, design, and features. By submitting signals, you grant Hopemeter a worldwide, royalty-free license to display your signal as part of the sentiment meter in perpetuity.

Minimal Data Collection

Hopemeter collects only the minimum data necessary to operate the platform: signal data, payment transaction confirmations, email address, IP address, and usage patterns for security. We do not collect, sell, or share personal information with third parties for marketing.

Payment Data Security

• PCI Compliance: All payment processing meets PCI DSS Level 1 standards
• Encryption: All data in transit uses TLS 1.2+ encryption
• Access: Only authorized personnel with need-to-know can access transaction records

Cookies & Tracking

Hopemeter may use cookies for authentication, session management, fraud detection, analytics, and preference storage. We do not use third-party tracking for advertising. You may disable cookies in your browser settings.

Privacy Rights & GDPR Compliance

• Access: Request access to personal data we hold about you
• Deletion: Request deletion of your account and associated data
• Correction: Update or correct personal information

Hopemeter complies with GDPR, CCPA, and other applicable privacy laws.

No Financial Advice or Guarantees

Hopemeter provides no financial advice, investment guidance, or guarantees. We do not guarantee the accuracy, completeness, uninterrupted operation, authenticity of user signals, or any particular outcome based on signal submissions.

Platform "As Is" Disclaimer

Hopemeter is provided on an "as is" and "as available" basis without warranties of any kind. We disclaim all warranties including merchantability, fitness for particular purpose, and non-infringement.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: Hopemeter LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or lost data, arising from your use of the platform.

Total Liability Cap: Hopemeter's total liability shall not exceed the amount you paid for signals in the 12 months preceding the claim, or $100, whichever is greater.

Assumption of Risk

By using Hopemeter, you assume all risks associated with platform use, including loss of payment, exposure to inaccurate signals, platform outages, and security breaches (to the extent permitted by law).

Right to Modify Terms

Hopemeter LLC reserves the right to modify these terms at any time, with or without advance notice. Changes become effective immediately upon posting. Your continued use of Hopemeter after any modification constitutes your acceptance of the updated terms.

How We Notify Users

• Major Changes: Material changes will be posted prominently and may be emailed to users
• Minor Changes: Updates to features or procedures may be posted without advance notice
• Continued Use: If you do not agree with changes, you may discontinue use of Hopemeter

Company Information

Hopemeter LLC is a limited liability company. All rights and obligations under these terms are binding on Hopemeter LLC and its successors and assigns.

Contact Details

Governing Law & Jurisdiction

These terms are governed by and construed in accordance with the laws of [Governing Jurisdiction], without regard to its conflict of law principles. You consent to the exclusive jurisdiction and venue of the courts located in [Court Location] for resolution of any disputes.

Dispute Resolution

• Informal Resolution: Contact Hopemeter to resolve disputes informally before pursuing formal action
• Negotiation Period: Parties agree to negotiate in good faith for 30 days
• Binding Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration
• Class Action Waiver: You waive the right to participate in class action lawsuits
• Small Claims Exception: Small claims court claims may proceed individually

Severability & Entire Agreement

If any provision is found to be invalid, it shall be modified to the minimum extent necessary to make it valid, or severed if modification is not possible. These terms, together with the Privacy Policy, constitute the entire agreement between you and Hopemeter and supersede all prior negotiations and agreements.
